Mark Dixie, 37, claims the jury at his murder trial should never have been told about his attempt to sexually assault a Jehovah's Witness 20 years ago and his lawyers will say that his case was prejudiced because of this.
His legal team will argue that the incident 20 years ago was so old that it should not have been brought up.

Killer: Mark Dixie is appealing against his conviction for murdering model Sally Anne Bowman
Dixie was jailed for life with a minimum term of 34 years in February after an Old Bailey jury heard he stabbed the 18-year-old seven times and had sex with her as she was "dead or dying".
The model's near-naked body was found in a pool of blood in the driveway of her home in Croydon, south London, a few hours later in September 2005.
The Jehovah's Witness told the trial how Dixie, then 17, cornered her in a lift, punched her in the face and grabbed her throat.
The woman, now in her 60s, said Dixie threatened to kill her.
Solicitor Julie Cooper, of Kingston-based law firm MacLaverty Cooper Atkins, confirmed Dixie was appealing against the conviction.
