'Jelly baby taunt victim' at centre of race bias claims

A Tube worker who was paid £125,000 compensation in a row over black jelly babies was today named as being at the centre of race discrimination claims by a white station supervisor.

Tom Mahoney, 58, is suing London Underground after he was allegedly intimidated by Daniel Jean-Marie, whose claims of racist bullying led to two co-workers being put on trial in October 2006.

Mr Jean-Marie, who is black, accused Vic Cooney and Carlos Rozza of taunting him by joking about biting the heads off black jelly babies, but a jury cleared them both of racially aggravated harassment in a case which cost taxpayers £250,000.

LU later paid Mr Jean-Marie £125,000 in an outofcourt settlement after he brought a claim of racial discrimination.

Mr Mahoney's case, which began today at Watford employment tribunal, centres on claims he was victimised by bosses after complaining about Mr Jean-Marie's "frightening" behaviour towards him.

Mr Mahoney, a supervisor at Caledonian Road station in north London, claims he was so frightened of what Mr Jean-Marie might do he had to change his route home. He told the tribunal that Mr Jean-Marie stood opposite his desk taking photographs of him during the criminal trial, making him "extremely nervous".

A London Underground spokeswoman said: "A claim has been brought against London Underground by a member of station staff. London Underground is contesting the claim and while the hearing is ongoing it would be inappropriate to comment further."

The case continues.
