Cleaner scandal judge keeps his job
22 January 2008
Judge Mohammed Ilyas Khan showed "poor judgment" in employing Roselane Driza without checking her immigration status, the inquiry by the Office for Judicial Complaints found.
But the Lord Chief Justice, Lord Phillips of Worth Matravers, said the investigation was not being pursued because of Judge Khan's ill health.
His criticisms also extended to the woman judge known as Judge J who jointly employed Ms Driza. She has taken early retirement.
Ms Driza was accused of blackmailing Judge J and stealing sexy videos from Judge Khan. At her trial it emerged Judge Khan, 61, was living with Ms Driza and described her as "chilli hot stuff".
The case was abandoned after new evidence questioned claims by Judge J.
During the trial, Ms Driza told the Old Bailey that one of the allegedly stolen tapes apparently showed Judge J snorting cocaine, while another featured Judge Khan cavorting with a mystery blonde woman.
Last year it was revealed Judge J received an annual salary of £101,948. Judge Khan stood down as a judge for the duration of the inquiry.
Lord Phillips said: "We have concluded on the basic evidence available to us that they demonstrated poor judgment in offering paid work to Ms Driza, without being assured of her immigration status.
"We have informed both of them that in our view their decision to engage Ms Driza in these circumstances was ill judged, particularly in the light of the jurisdiction within which they both worked."
