Dando killer launching bail bid

The man convicted of the murder of TV presenter Jill Dando is to apply for bail ahead of his second appeal in November.

Barry George heard in June that the Criminal Cases Review Commission (CCRC) had referred his case to the Court of Appeal after "a thorough and intensive review".

His new legal team, headed by Edward FitzGerald QC, will make the application to Mr Justice Treacy in a hearing on Tuesday. George, 47, is not expected to be in court.

BBC presenter Miss Dando was shot dead on the doorstep of her home in Fulham, south west London, in April 1999.

The 37-year-old was known for her work as a presenter for BBC News and a variety of programmes including travel show Holiday and the crime appeal series Crimewatch.

George, who lived close to Miss Dando, was given a life sentence in July 2001 after being found guilty of killing the presenter on a majority verdict.

The CCRC based its decision to refer the case back to appeal on new evidence which calls into question firearms discharge evidence used by the prosecution at George's original Old Bailey trial "and the significance attached to that evidence".

The Court of Appeal dismissed his first appeal against conviction in July 2002. But lawyers acting for George launched a new bid to clear him later that year.

The CCRC said when it announced its decision that a large number of issues were put forward by George's lawyers, but these do not form the basis for the referral to the appeal court which will hear the case for three days starting on November 5.

The Court of Appeal is required to hear the appeal only on the grounds specified by the Commission, but George can seek permission to argue additional points.
