Lawrence killer case ignites EU row

Pressure is continuing to mount on the Government over the influence of European law on British courts following the decision not to deport the killer of head teacher Philip Lawrence.

An Immigration Tribunal has ruled that Learco Chindamo should not be deported to his native Italy once he has served his prison term.

The tribunal ruled that deportation could not be used as a "mode of further punishment" under EU law, drawing fierce criticism from the Tories.

Justice Secretary Jack Straw will appeal against the decision and said at the time Chindamo was sentenced there was a "clear expectation that this man, given the severity of the crime he had committed, would indeed be deported to Italy".

Shadow home secretary David Davis said: "The Government is trying to blame the courts but it signed up to the EU law in question and continues to cede the powers to deal with dangerous individuals like this to Brussels."

Mr Lawrence was stabbed to death in an attack outside St George's Roman Catholic School in Maida Vale, west London, in December 1995, while trying to protect a 13-year-old pupil.

Chindamo, who was just 15 at the time, punched and stabbed father of four Mr Lawrence, who died the same evening.

The Home Office presented evidence to the tribunal claiming that Chindamo, now 26, poses a "genuine and present risk" to the public.

But a summary of the tribunal's ruling stated: "The tribunal took the view that the rules of EU law allowed deportation to be used neither as a mode of further punishment of offenders nor in order simply to dissuade other aliens from committing similar crimes.

Mr Lawrence's widow, Frances, said she had always been given the impression that the killer would be deported at the end of his sentence. Mr Straw has offered to meet Mrs Lawrence next week to discuss the case, and promised to "vigorously appeal" against the ruling.
