Mark Saunders, 32, was killed by police marksmen on May 6 at the flat in Chelsea, London, which he shared with his wife.
His younger sister, Charlotte, 26, is seeking a ruling that police officers involved in the fatal shooting were unlawfully allowed to collaborate and confer and send a written report on how her brother came to die to the IPCC.
Mr Justice Charles, sitting in London, also gave Ms Saunders permission to challenge the IPCC's refusal to give her access to information already obtained from the officers about "why they decided to shoot".
Tim Owen QC, appearing for Ms Saunders, told the judge: "We are simply asking what is it officers have said on why they decided to shoot at that particular stage - that is what the family is crying out to understand."
The judge ruled there was "an arguable case" and ordered that the application for judicial review should be heard as a matter of urgency.
