Toddler fight women sentences stand

Suspended prison sentences given to four women who filmed two toddlers they forced to fight will not be referred to the Court of Appeal, the Attorney General has ruled.

Lord Goldsmith said that while their conduct was "fully deserving of the condemnation that it has received", another higher court would not now jail them.

He had been asked to review the punishments by Conservative MP Mike Penning, who hit out at the decision and said the law appeared "completely perverse".

In a statement, Lord Goldsmith said: "After a very careful review of the case, the Attorney General has decided not to refer the sentences to the Court of Appeal.

"Having viewed the video evidence, the Attorney General considers that the offenders' conduct is fully deserving of the condemnation that it has received.

"The judge did though consider the evidence carefully himself and reached a decision that, in the Attorney's view, he was entitled to take in the exercise of his independent judgment.

"A decision whether or not to refer a case is made on legal grounds taking into account all the relevant information.

"Here, the Attorney General has concluded that the Court of Appeal would not now imprison the offenders if he were to refer this case."

Zara Care, the children's mother, her sisters Serenza and Danielle Olver and her mother Carole Olver forced the two toddlers to punch each other in the face.

All four women, from North Prospect, Plymouth, Devon, pleaded guilty to child cruelty charges and were each sentenced by Judge Francis Gilbert to 12 months in prison suspended for two years, at Plymouth Crown Court in April. They were also ordered to carry out 100 hours of community service and banned from working with children.
