Whips fear detention vote defeat

The Government's own Whips are convinced it will suffer a humiliating defeat over plans for 42-day detention without charge.

A leaked list of potential rebels reveals that 50 MPs - including 10 former ministers - are expected to vote against the extension.

Environment minister Joan Ruddock is said to regard the new limit as "plucked from thin air" - although she had consented to back it.

With the Tories and Lib Dems opposing the terror Bill, the roll call - compiled by Whips earlier this year - indicates that the Government is set to lose by at least 20 votes.

A further 44 Labour backbenchers had not decided whether to support the measure at that time.

The nine-page dossier, seen by the Sunday Times, names six aides to ministers who have question marks over their commitment.

They include Treasury number two Yvette Cooper's Parliamentary Private Secretary (PPS) Angela Smith, who sparked panic in Downing Street this week when she threatened to resign over the abolition of the 10p tax rate.

The others are Chris Bryant, PPS to Commons leader Harriet Harman; Lyn Brown, PPS to Universities Secretary John Denham; Mark Lazarowicz, PPS to Scotland Office minister David Cairns; Madeleine Moon, PPS to schools minister Jim Knight; and Judy Mallaber, a PPS to Baroness Ashton, the leader of the Lords.

Shadow home secretary David Davis said: "This demonstrates, as we have been saying all along, that 42 days is a friendless policy even in the Labour Party.

"It has split the Labour Party from top to bottom, from Jack Straw to the lowliest backbencher. Even those voting for it think it is a ridiculous policy. It does nothing to either protect our liberty or defeat terrorism."
