The 21-year-old, who spent two months in rehab last year for alcohol addiction, was seen drinking vodka during a night out in New York.

Witnesses claim that Lohan drank "at least two" vodka cocktails at Manhattan celebrity hotspot, the Beatrice Inn.

The Mean Girls actress was partying with ex-boyfriend Stavros Niarchos and MTV reality star Brody Jenner.

A friend told the New York Daily News: "Lindsay is learning how to work through her addictions and, once in a while, she chooses to have a cocktail.

"People over-exaggerate her behaviour when in fact on Friday night, many people commented to her on how composed she was."

Lohan was also caught out on New Year's Eve, when she was filmed drinking from a bottle of Champagne at a nightclub in Capri.

"There is no magic cure here. Unfortunately, Lindsay has to share her 'one day at a time' with the entire world," Her lawyer Blair Berk said at the time.

The star was said to have been very affected by the death of her rumoured former lover Heath ledger last week and was seen leaving a Hollywood restaurant in tears after learning of the Brokeback Mountain star's demise.

In December 2006, Lohan revealed that she had been attending Alcoholics Anonymous meetings for about a year, then in January 2007 she checked in for a month in rehab.

In May, Lohan checked into rehab for another six weeks after being arrested for driving under the influence when she crashed her car.

Shortly after completing rehab in July, Lohan was arrested for a second time, this time on charges of drunken driving and cocaine possession.

She checked into rehab for a third time, spending two months at a center in Utah.
