However, Ortega wants £125,000 compensation and an LA court has set a trial for April.
Mr Ortega claims the star was fleeing photographers and was drink-driving. But traffic police concluded at the time that Mr Ortega caused the accident by making an illegal U-turn. Lohan and a passenger sustained minor injuries.
Mr Ortega's lawyer, Robert G Klein, said outside court in Los Angeles: "This case is about responsibility and she's not taking responsibility".
Lohan's lawyer, David J. Ozeran, said there was no evidence that Lohan was intoxicated.
Last month, Lohan agreed to spend a day in jail and complete a drug treatment program after pleading guilty or no contest to misdemeanor drunken driving and cocaine charges stemming from arrests earlier this year in Beverly Hills and Santa Monica.
Meanwhile, Lohan was visited in rehab by her father Michael, their first meeting in three years.
