It is said the Los Angeles District Attorney's Office are now considering dropping three charges against the 'Mean Girl', including the cocaine charges from her memorial day arrest.
These will all likely be downgraded to misdemeanours, for which she will only face four days in jail.
The District Attorney may also drop the cocaine charges for her last arrest on 24 July, when she was caught chasing another car in her SUV.
Previously, it had been thought the actress who checked into Circle Lodge Rehab Centre following her arrest for drink driving last month, would be facing serious jail time, after Californian law states second offence drink-driving offences face up to 30 days in jail, not including the drug charges or driving on a suspended license.
But Lohan's great escape comes after her lawyer Blair Berk has reportedly been negotiating a deal with prosecutors.
Her possible four day sentence will be a similar to that of fellow LA party-girl Nicole Richie, who must serve four days in jail for driving under the influence of alcohol and drugs before the end of the September.
Drug-addict rocker Pete Doherty, also escaped jail as well this week for breaching the conditions of his bail due to a police blunder which let him off on a technicality.
