Lindsay Lohan 'named' in divorce papers of British heiress

A British heiress has started divorce proceedings in the wake of claims that Lindsay Lohan had sex with her musician husband in the toilet of a rehab clinic.

Sensational divorce papers identifying Mean Girls star Lohan were filed last week by US lawyers acting for Stephanie Allen, 28, whose family is worth £720 million.

Mother-of-two Stephanie, from Lincolnshire, pulls no punches against her husband Tony, 39, the Dead Stays Alive frontman, in the 52-pages filed in Chatham County Court in Savannah, Georgia.

Stephanie states that her three-year marriage "is irretrievably broken" and gives the grounds for divorce as his "adultery" and "cruel treatment".

The papers also accuse her husband of being "guilty of habitual drug addiction" and that she should retain custody of their eight-month-old twins.

The lawyers do not name Lohan in the actual complaint but they refer to her husband's "conduct and relationship with another woman" as described in an American magazine and on showbiz internet sites.

But Exhibit 'A', which is attached to the divorce papers, includes articles claiming Lohan, 21, who has had an on-off affair with Calum Best, started a relationship with Tony Allen while they were both being treated at the Cirque Lodge clinic in Utah.

One of the articles attached to the exhibit was featured last week in America's In Touch magazine. It states that there has been "no word on whether or not Tony was the fellow rehabber caught bonking Blohan in a Cirque Lodge john".

Stephanie's lawyers chose the magazine article to support her case for divorce because it quotes an onlooker as saying: "They looked very cute together. You could definitely tell from watching them that there was something going on. It was very apparent they were a couple."

Another insider reportedly told the magazine: "He's an artist, so he and Lindsay could relate. No-one else in rehab at the time was in the entertainment industry, so I think that's how they started talking, and they bonded that way.

"They were bound to get close – it just happens, especially when two people have so much in common."

The source went on to say Tony had left rehab but intended to stay in contact with Lohan who is still in the drugs clinic.

The papers reveal that Stephanie wed Tony on December 18, 2004, and lived together as "husband and wife" until August 24 this year in their £850,000 home near Savannah, Georgia. They started "living in a bona fide state of separation" about a month ago, according to the documents.

Stephanie's lawyers ask the court to keep secret details of a 'Post-Nuptial Agreement' between Tony and the heiress whose family founded the Lincolnshire-based Linpac packaging company which makes boxes for McDonald's.

They also ask for the financial agreement which was entered into on November 18, 2005 - eleven months after their marriage - to be enforced.

A huge amount of money could be at stake as Stephanie's dad and his four sisters sold Linpac in 2002 netting the family a cool £720 million fortune and still kept a £140 million stake in the company.

In her affidavit to the court Stephanie says: "The Post-Nuptial Agreement sets forth my separate property and also defines and sets forth what is considered marital property."

She continues: "My husband entered a drug rehabilitation centre in Utah...on or about July 11, 2007. After my husband's return from said rehabilitation I was bombarded by telephone call alerting me to the fact that my husband's conduct with another woman was on the internet and in gossip magazines.

"I am in fear that if my financial circumstances become public record, reporters will be camped outside my home. I am in fear for the safety and well being of my family including my children."

Stephanie is said to have been "devasted" by the allegations that Tony had sex with Lohan in a toilet and booted him out of their home.

A friend reportedly said: "She has had it, period. They tried forever to have kids. She went through IVF three times and suffered two miscarriages, and when they finally got two beautiful babies, he hooks up in rehab with a girl half his age."

Tony has denied the Lohan sex claims, saying: "We're great friends. We share a common affliction, and we just talk about life sometimes."

But another report claims that when mates in a bar quizzed him about it, he boasted: "C'mon, it's Lindsay Lohan. Hell, yes! Wouldn't you?"

In one of the internet reports provided to the court, Lohan is said to have written to a friend: "I met a guy, Super sweet and caring."

But, she added: "He's got someone, and I don't want to come between any relationship. I'd hate to be the other woman."

Her representatives insist Lohan has not written about a rumoured romance.

In July Lohan was arrested for drink-driving and cocaine possession after a 2am car chase in Santa Monica, California, in which she pursued the terrified mum of her recently-resigned personal assistant.
