The 21-year-old Lohan was captured on video, posted on celebrity Web site TMZ.com, sipping from a champagne bottle in Italy where she was honored at the Capri Film Festival.

Off the wagon: Linday Lohan was pictured drinking from a champagne bottle at New Years Eve party

"After being handed a champagne bottle while on a dance floor in Italy on New Year's Eve and drinking from it, the good news is that Lindsay immediately stopped, called her sponsor, and got herself back on track," lawyer Blair Berk said in a statement.

"There is no magic cure here. Unfortunately, Lindsay has to share her 'one day at a time' with the entire world," Berk said.

Lohan rose to fame as a child star in Disney movies such as "The Parent Trap" and "Freaky Friday."

As a young adult, she gained a reputation as an up-and-coming actress in films such as "Bobby" and "A Prairie Home Companion."

Lohan was seen getting hot and heavy with actor Dario Faiella during her Capri trip

In December 2006, she said she had been attending Alcoholics Anonymous meetings for about a year, then in January 2007 she checked in for a month in rehab.

In May, Lohan checked into rehab for another six weeks after being arrested for driving under the influence when she crashed her car.

Shortly after completing rehab in July, Lohan was arrested for a second time, this time on charges of drunken driving and cocaine possession.

She checked into rehab for a third time, spending two months at a center in Utah.
