The Latics are one of four clubs - along with Fulham, Sheffield United and Charlton - threatening to challenge the decision not to dock points for the Hammers' illegal signing of the player.
Spencer told BBC Radio Five Live: "We just want to make sure everything was done correctly and he was eligible to play. If the Premier League prove to our chairman and the club that everything was done correctly and there is no problem, we will accept that."
Manager Paul Jewell, meanwhile, does not want to avoid relegation solely because of a points deduction for the Hammers.
"I don't want to stay up off the back of a court case and West Ham docked points," he told the Daily Star. "I want to stay up because we won our last match."
Asked about the future of Jewell should the Latics be relegated on Sunday - if they fail to beat Sheffield United they will go down - Spencer said: "That's a difficult one.
"Paul knows what he wants to do and that will be Paul's decision. I wouldn't like to see it and I'm sure the chairman of the club wouldn't like to see it with our players or Paul."
