Fulham and Wigan may claim £1m from Carlos Tevez affair

Ken Dyer, Evening Standard
30 Sep 2008

West Ham, already contesting a multi-million pound damages claim from Sheffield United over the Carlos Tevez affair, could now face a £1m legal action from Fulham and Wigan.

After an FA independent tribunal ruled that Tevez was worth at least three points to West Ham in their successful fight to avoid relegation in the 2006-07 season, both clubs may argue that their final position in the Premier League was one lower than it should have been — a difference of about £500,000 each.

West Ham will appeal to the Court of Arbitration for Sport over the ruling.

Chief executive Scott Duxbury also denies he told Tevez's 'co-owner' Kia Joorabchian and his lawyer that the club would publicly tear up the third party agreement but privately honour the arrangement.

There is no such thing as an under strength side. You can play any of your registered players. The complaint against West Ham was that they played a player who was not properly registered and continued to play him after they acknowledged he was not properly registered. The fact that Tevez is playing for Man Utd while still being "owned" by a third party of course muddies the waters. Does the FA have different rules for Man Utd (such FA Cup exemption)? Thus another fine mess from our football authorities. Maybe they should take up banking.

there is a PL ruling that stops PL clubs suing each other so maybe they should read the rule book first

This is now becoming ridiculous and it will make the football league and premier league become the laughing stock in Europe. As a Hammers supporter I can partly understand the feelings of other clubs BUT we attended a hearing ,we were found Guilty, we received a record fine. Thats it -end of.If people feel we were let off easy then the fault lies with the tribunal not WHU. If sheff U have a claim for compensation it should be aimed at the FA and premier league for either not awarding compensation at the earlier hearing or ruling on a case without establishing all the facts. As for players receiving compensation -that is a joke - if those players had performed better they would not have been relegated. Were the fined for poor performance -no did they get their wages yes.
I also agree with SUPERNUMBERSIX do we now start to fine clubs for fielding weakened sides which possibly allows teams to gain points they would not have won which can have a knock on effect towards relegation and possibly europe qualification. The sad thing is its a sport that we love but is now a rich greedy mans play-thing an its the honest supporters who spend hard earned money who suffer. So enough of this CRAP . Let the league pay the compensation from the millions they earn and send out a warning that all clubs will be severley dealt with if found guilty of any infringement., and continued appeals will expect fines/etc to be increased . Please stop ruining the sport we love !!!

Except that Premier League rules expressely forbid one Premiership club from suing another ?

If the arbitration panel found west ham to have benefited by at least 3 points over sheff utd, then every team whu played were robbed of 3 points surely, not just those that went down but those who missed out on uefa cup place or a champions league place, plus the premier league payments for position in the table.I think every team should sue west ham, even those who played whu in cup competitions. i think the whole amount payable and this is a consevative estimate, would come to nine hundred and seventy three zillion billion and 40 pence. Time to wrap this saga up dont you think. No money will change hands, it cant, put in a ruling, (yes like the one we already have with the premier league that sheff utd ignores) and get over it.

Understrength Liverpool Team? - You should check your records. I think that you will find that the vast majority of those Liverpool players who played at Fulham, also played in the Champions League Final 2 weeks later.

Does this mean that WHU can sue Liverpool for fielding an understrength side against Fulham, thus allowing them to stay up and contributed to Sheffield United going down?? Or does that sound too ridiculous??
