Briton acquitted over baby's death

30 Jun 2009

A British woman has been acquitted of killing her newborn son after giving birth during a holiday to Crete, her lawyer has said.

Leah Andrew, 21, from Hither Green, south-east London, was arrested last July after giving birth alone in her Malia hotel room to a boy who was later found dead.

She was detained and charged after a coroner said the baby had been born alive and died of suffocation.

Miss Andrew's lawyer Zoe Lama said Miss Andrew had been acquitted of killing her newborn son in the Natali hotel.

Miss Andrew, who has two other children, fainted at an earlier hearing and was taken to hospital suffering from bleeding.

Ms Lama said the court in the Cretan town of Rethymno issued its decision on Friday and found Miss Andrew not guilty of infanticide.

Miss Andrew spent 11 months in custody while awaiting trial and could have faced a maximum sentence of 20 years if convicted.

Ms Lama said Miss Andrew will be released from custody and will return to Britain later this week. Miss Andrew and her family were "very pleased with the decision", she added.

Miss Andrews had been on a night out with her 24-year-old sister, Lydia, and a friend, before she returned to the hotel room alone at about 3.30am on July 21, 2008.

She gave birth alone and when her sister and friend returned to the room, they saw the baby wrapped in sheets and called the police.
